Terms and Conditions
- THE TERMS
1.1 The following terms govern the sale of Winding Road Distillers Circle (WRDC) memberships sold by us (‘Winding Road Distilling Co.’) and herein form the contract between us and you (‘member’ or ‘purchaser’ of the WRDC).
1.2 We request that you please read these terms and conditions carefully prior to applying to join the WRDC and purchasing a membership. These terms and conditions outline how we will sell products to you, how you or we may change or end the contract, what to do if you encounter a problem, and other important information relevant to the WRDC membership.
- OUR CONTRACT WITH YOU
2.1 ACCEPTANCE OF YOUR APPLICATION TO JOIN. Our acceptance of your application to our Winding Road Distillers Circle will occur upon receipt of your application (‘Order’), your payment has cleared, and we have confirmed your order in writing, at which point the contract between you and us comes into existence. You are responsible for ensuring the information you provide to us in the order is complete and correct.
2.2 COUNTRY OF RESIDENCE RESTRICTIONS. Winding Road Distillers Circle Memberships are only open to residents with an Australian address we are not set up for exports at this time.
2.3 AGE RESTRICTIONS. By placing an order, you acknowledge that you are minimum 18 years of age. We do not accept orders from or arrange delivery of alcohol to persons under the age of 18 at the date of the contract.
2.4 ORDER REFUSAL. We reserve the right to refuse an Order. If we cannot accept your order, we will inform you of this in writing and will not charge you. Reasons may include but are not restricted to unexpected limitations on our resources which we could not reasonably foresee, payment that has not been authorised, or we find that you are under the legal minimum drinking age. Any monies paid by you in relation to that order will be refunded within 14 calendar days of our refusal, as notified to you in writing.
2.5 We reserve the right in our sole discretion, to limit or cancel Orders purchased per person, per household or per order. These restrictions may include but are not limited to Orders placed by or under the same name, the same credit card, and/or Orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an Order, we may attempt to notify you using the information provided at the time the order was made. We reserve the right to limit or prohibit Orders that, in our sole judgement, appear to be placed by dealers, re-sellers or distributors.
2.6 YOUR WINDING ROAD DISTILLERS CIRCLE MEMBER NUMBER. A unique member number will be assigned to you and provided after we have accepted your Order.
2.7. WINDING ROAD DISTILLERS CIRCLE WEBSITE PAGE. Members’ names will appear on a page within our website. You can inform us in writing if you do not want to be listed. We also reserve the right to remove names of members from the Winding Road website.
2.8 TRANSFER OF PACKAGES. The transfer of packages to another person may be possible however should not be undertaken without our prior written consent as detailed in clause 9.3 of these Terms and Conditions.
- PAYMENT
3.1 Confirmation of membership will not occur until payment has been processed and received in full.
- PRICING AND AVAILABILTY
4.1 All pricing information on the website is correct at the time of going online. We reserve the right to modify prices and alter or remove any offers or services without notice at any time.
4.2 In the event that prices are changed during the period between an order being placed and us processing that order and taking payment, the price will be that displayed during the checkout process prior to payment.
4.3 We reserve the right, but are not obligated, to limit the sales of our products or services to any person or geographic region. We will exercise this right on a case by case basis.
4.4 We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time.
4.5 The membership fee (‘Price”) for the Winding Road Distillers Circle Membership is $330 (AUD) and is inclusive of GST, bottling and packaging costs and postage to Australian addresses only.
- GOODS
5.1 FIRST DELIVERY. All Winding Road Distillers Circle Members will receive a Welcome Pack, sent within approximately two months of receiving online confirmation from us. The pack will include a Distillers Circle welcome letter and membership card, one Winding Road 6-panel adjustable unstructured baseball cap, and two Glencairn glasses engraved with the Winding Road Distillery logo. In addition, each member will receive a 700ml bottle of Winding Road Distilling Co. Citrus and Sea Gin and a 700ml bottle of Winding Road Distilling Co. Rum Agricole Blanc Virgin Cane Spirit.
5.2 SECOND DELIVERY. Each member will receive their choice of a 700ml bottle from our first release Single Malt Whisky or Agricole Rum. Whisky and Rum will be bottled after the minimum legal maturation term of two years has elapsed and when the whisky/rum has reached maturation. The point of maturation will be determined by us and is anticipated to be between 2-4 years from the date of cask filling. The Distillers Circle reserved bottles will be drawn from casks SM01 and AR01 for the whisky and rum respectively. There will be a difference between the maturation date of the Single malt whisky and Agricole Rum.
5.3 We will use all reasonable endeavours to ensure timely delivery of the Welcome Pack, Citrus and Sea Gin, and Agricole Blanc Virgin Cane Spirit as set out in clause 5.1. Delivery of the Single Malt whisky or Agricole Rum as set out in clause 5.2 will occur as soon as possible following the maturation periods and in any event, no later than six months after the end of the relevant maturation period.
5.4 Alcohol strength at bottling will be determined solely by Winding Road Distilling Co.
- DELIVERY OF GOODS
6.1 Goods will be delivered to the delivery address supplied at the time of Order unless you have notified us previously of a change. It is your responsibility to ensure the information provided is correct. We cannot accept any liability for late or failed delivery if the address provided is incomplete or incorrect. You will be liable for any additional delivery costs resulting from a change of address, and this must be paid in full prior to the goods being re-dispatched. You can notify us of a change of address by email at info@windingroaddistilling.com.au. Please ensure you receive an acknowledgment of your new address from us. We cannot deliver to PO boxes.
6.2 DELIVERY CHARGES. There are no delivery charges for orders with a correctly supplied Australian address. Due to alcohol export restrictions, we cannot deliver to addresses outside of Australia at this time (see 2.2).
6.3 We will not be liable for a failure to perform, or delay in performance of, any of our obligations that is caused by circumstances or events beyond our control. If such circumstances continue for a period of longer than 6 months, you then have the right to terminate the contract.
6.4 FAILED DELIVERY. In the event that goods are returned to us due to non-delivery, we will attempt to contact you by email or telephone to arrange re-delivery at your expense. If we are unable to make contact with you following all reasonable attempts we shall be entitled to dispose of the undelivered goods as we see fit without liability to you and we shall be released from any future liability to deliver any remaining outstanding goods in connection with your package.
- FAULTY, DAMAGED OR INCORRECT GOODS
7.1 We hope that you will be happy with the goods that you receive in connection with the Winding Road Distillers Circle. However, should you feel it necessary to return an item because it is faulty, different from its description at the time of purchase or different to what you ordered, please contact us at info@windingroaddistilling.com.au within 14 days to inform us of the fault or error and to arrange a refund or replacement.
7.2 GOODS DAMAGED IN TRANSIT. We will take great care to package your order to ensure that it arrives in perfect condition. Unfortunately, some parcels may incur damage while in transit. If you discover that your goods are damaged, please notify us promptly in writing and with photographic evidence of the damage no later than 7 days after the date of delivery. Provided that acceptable notification is received within this time, we will replace the damaged goods where a replacement is available and bear the associated costs. In the event acceptable replacement goods are not available, we will refund you the amount paid for the individual damaged goods.
- OTHER BENEFITS
8.1 DISTILLERS CIRCLE NEWSLETTER. Members will be sent a Welcome Newsletter to the email address provided on registration. Following the Welcome Newsletter, Members will receive an email newsletter quarterly. This is an optional benefit and Members may choose to opt out receiving this at any time. The frequency of the newsletters may change, depending on the availability of relevant updates and other information.
8.2 SOCIAL MEDIA. We may at a future date establish a closed group on Facebook for Distillers Circle members. Members’ participation in this group would be optional.
8.3 PRIORITY TO PURCHASE NEW RELEASES. Members will be given priority notification to purchase new release products. Notifications will be sent to the email address provided. It is up to the Member to notify us of any changes to your email address.
8.4 DISCOUNTS. From time to time, Winding Road Distilling Co. may offer discounts on products as an exclusive benefit to our Distillers Circle members.
8.4 ACCESS TO THE DISTILLERY. Our distillery operates from our private property and is not a publicly accessible venue. However, when possible we will invite Members to visit our facility by prior appointment.
- OTHER IMPORTANT TERMS
9.1 We reserve the right to make any changes in the specification of the goods that may be required to conform to any applicable safety or other legal or regulatory requirements without notice.
9.2 We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Contract.
9.3 You may only transfer your rights or obligations under these terms to another person if we agree to this in writing. We may not agree if that person is an existing Member.
9.4 If any portion of these terms and conditions are prohibited, invalid or unenforceable in any jurisdiction, that provision will, as to that jurisdiction, be ineffective to the extent of the prohibition, invalidity or unenforceability without invalidating the remaining provisions or affecting the validity or enforceability of that provision in any other jurisdiction, unless it materially alters the nature or material terms of this document.
- PRIVACY
10.1 We will use the personal information you provide to us: to process your payment; to supply the goods to you; and if you agreed to this during the order process, to give you information about other similar products we provide. You may stop receiving this at any time by contacting us.
10.2 We will only give your information to third parties where the law requires us to do so.
